Terms of Service

These terms govern your use of the GuardianRide website, mobile apps, and dashboards (together, the “Service”). By using the Service, you agree to these terms. If you do not agree, please do not use the Service.
1. Who can use the Service
You must be at least 18 years old, or be using the Service with the supervision of a parent or guardian who agrees to these terms on your behalf. Where a school account is set up, the school is the customer; parents, drivers, and staff use the Service under the school's account.
2. Your account
- Provide accurate information when you sign up and keep it up to date.
- Keep your login credentials confidential. You are responsible for activity on your account.
- Tell us promptly if you suspect unauthorized access to your account.
3. Acceptable use
Don't use the Service to:
- Break the law, harm others, or facilitate harm.
- Upload material that infringes someone else's rights, including intellectual property and privacy.
- Attempt to access another user's account or data without permission.
- Probe, scan, or interfere with the security of the Service.
- Reverse-engineer, decompile, or copy the Service except where law expressly permits.
- Use the Service to send spam or unsolicited commercial messages.
4. Schools, parents, drivers
Where a school is the customer, the school decides what data is collected from its parents, students, and drivers. We process that data on the school's instructions, as set out in our privacy policy and any data processing agreement we sign with the school. Schools agree to provide the appropriate notices and obtain the necessary consents from parents.
5. Subscription, fees, and refunds
Some parts of the Service are paid. Pricing, billing cycles, and any free trial terms are described in your order or account settings. Fees are billed in advance and are non-refundable except where required by law or where we otherwise specify in writing. We may change pricing with reasonable notice; price changes apply from the next renewal.
6. Intellectual property
The Service, including its software, design, text, and graphics, is owned by GuardianRide or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with these terms. You retain ownership of the content you submit through the Service, and you grant us the rights necessary to provide the Service to you and your school.
7. Third-party services
The Service may rely on third-party services (for example, maps, push notifications, payment processors). Their use is governed by their own terms; we are not responsible for their content or behavior.
8. Service availability
We work hard to keep the Service running, but we do not guarantee uninterrupted availability. We may pause the Service for maintenance, security, or operational reasons, and we will give reasonable notice where practical.
9. Disclaimer
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service is a tool that supports school transport operations; it does not replace the school's, driver's, or parent's responsibility for the safety of children.
10. Limitation of liability
To the maximum extent permitted by law, GuardianRide is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of these terms or the Service is capped at the fees you paid us in the twelve months before the event giving rise to the claim, or, if no fees were paid, INR 5,000.
11. Indemnification
You agree to defend and indemnify GuardianRide against claims arising from your misuse of the Service or breach of these terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these terms or if we are required to by law. On termination, sections that by their nature should survive (intellectual property, disclaimers, limitations of liability, governing law) continue to apply.
13. Changes to the terms
We may update these terms as the Service evolves. When we make material changes, we will post the updated terms here with a new “last updated” date and, where appropriate, notify you in the app or by email. Continued use after the change means you accept the updated terms.
14. Governing law and disputes
These terms are governed by the laws of India. Any dispute arising out of or relating to these terms or the Service will be subject to the exclusive jurisdiction of the courts at the location of GuardianRide's registered office. Where required by law, this section does not affect any non-waivable consumer rights you may have.
